Arizona Sex Offenses Lawyer

Under Arizona statute 13-3212, Arizona lawmakers have increased the punishment for crimes categorized as child prostitution. Convicted offenders now face mandatory prison for what used to be a misdemeanor.

A person commits child prostitution if they:

  • Permit or cause a minor to engage in prostitution
  • Are engaging in prostitution with a minor under 15 years old (regardless of whether they know the age of the child), or if they engage in prostitution knowing the child is 15, 16 or 17
  • Transporting a minor for the purpose of the child engaging in prostitution
  • Overseeing or receiving any benefit from child prostitution

These crimes are considered Class 2 felonies, punishable by a minimum of seven years and a maximum of 21 years in prison for first-time offenders. For those with a prior conviction under 13-3212, the minimum sentence is 14 years in prison with a maximum of 28 years. Two or more prior offenses impose a minimum of 21 years in prison with a maximum of 35.

A person convicted of this crime will not be eligible for suspension of sentence, probation, pardon or release until his or her sentence is completed.

If a person engages in prostitution with a minor who is 15, 16 or 17, but does not know the minor is under age 18, they have committed a Class 6 felony. The punishment for this crime is considerably less, although still involving mandatory jail time of at least three months.
